Acceptance of these Terms
These Terms are a contract between you and CLZTR SpA. They govern your use of the CLZTR mobile app, clztr.com, clztr.app and everything we offer through them (together, "CLZTR" or "the Service").
Please read section 12 (Safety), section 15 (Limits on our liability) and section 17 (Disputes). They affect your legal rights.
By using CLZTR you agree to these Terms. If you do not agree, do not use CLZTR.
1. Who you are contracting with
These Terms are an agreement between you and CLZTR SpA, a company incorporated in Chile, represented by its Gerente General, Luis Felipe Jiménez Roldán ("CLZTR", "we", "us").
Our full company details, registered office, tax and registry identification, contact email and telephone number, our hosting provider, our representative in the European Union, and the information particular countries require us to publish, are set out in our Legal Notice. That page is linked from the footer of every page on our website and from Settings › Legal in the app, and it forms part of the information we are required to give you. Please read it before you accept these Terms.
When you create an account we email you a copy of these Terms together with those company details, so that you have both in a form you can keep.
If you are a consumer, nothing in these Terms removes the protection of the mandatory consumer law of the country where you live. Section 17 explains which law applies to you and where you can bring a claim.
2. What CLZTR is
CLZTR is a live map of what is happening around you. It shows gatherings, events and venues, and it lets you find them, join them, create your own and meet the people who are there.
CLZTR is built for real people. Everyone who uses it passes a check that confirms a real, live human being is present. Section 5 explains how that check works. Section 3 explains how we check your age, which is a separate thing.
CLZTR is not an emergency service, a background-check service, a security service, or a guarantee about anyone you meet. Please read section 12.
3. Who can use CLZTR
You must be 18 or older to use CLZTR. In Puerto Rico you must be 19 or older.
You must also:
have the legal capacity to enter into this contract;
not have been banned from CLZTR previously;
not be barred from using our services under the laws that apply to you.
How we check your age. If you use CLZTR without an account, you give us your date of birth before you get in, and you give it again if you reinstall the app or move to a new device, because nothing is kept about you between those points. If you have an account, we read your date of birth from the identity document you scan, and that is the date we rely on. The check described in section 5 plays no part in this: it does not estimate your age, and it does not estimate anything else about you.
CLZTR is not available in every country. Some features are limited or unavailable in some places, for legal reasons or for your safety. We will tell you if CLZTR is not available where you are.
If we learn that someone under 18 is using CLZTR, we will close the account and delete their personal data immediately. If you believe a minor is using CLZTR, contact service@clztr.com and we will act within 24 hours.
4. Two ways to use CLZTR
You choose how you use CLZTR. There are two ways in, and you are never forced into either one.
Without an account. You use CLZTR anonymously on your device. To get in, you complete a quick check that confirms a live person is holding the phone. You repeat that check about once a month, and sometimes sooner if something changes, a new device, a reinstall, or a safety signal. We do not know who you are, and we do not ask.
With an account. You sign in with your email address and verify your identity once by scanning an identity document. After that you are verified permanently and we will not ask you to do the face check again.
You can switch from anonymous use to an account at any time.
Which option is available depends on where you are. In some places only the account option is offered. In Illinois, for example, we have switched the face check off, so the account is the only way in.
If you use CLZTR anonymously, your access is tied to that device. If you change phones, reinstall the app, or reset your device, you start again as a new anonymous user and you cannot carry over your history, your friends or your purchases. That is the trade-off of not having an account.
5. The check that confirms you are a real person
This section describes exactly what happens, because we think you should know.
5.1 The face check (anonymous use)
This check does not run in Illinois. If you are in Illinois we do not turn on your camera, we do not ask you for this check, and the consent paragraph at the end of this section does not apply to you. The same is true anywhere else we have switched the face check off. In those places you use CLZTR with an account instead, as described in section 4.
Everywhere the check is offered, this is what happens. When you use CLZTR without an account, we ask you to complete a short check about once a month, and sooner if you change device, reinstall the app, or we are looking into a safety report:
Your camera turns on and asks you to follow a few short prompts, such as blinking or turning your head.
The whole check runs on your phone. It uses Google ML Kit, which is built into the app and works offline, together with CLZTR software. Nothing about the check is decided on our servers.
We do not create or keep a faceprint, face template, face embedding, face vector, face hash, or any record that could be used to recognise you later. No such thing is produced at any point, not even briefly.
No image or video from your camera is ever sent to us or to anyone else, and none is saved on your phone. Your camera frames are never written to a file.
While the check is running, the software does read a few things from the camera in order to know whether you are following the prompts: where your face is in the frame, which way your head is turned, whether your eyes are open, and whether you are smiling. Those readings exist only in your phone's memory for a fraction of a second, are replaced by the next frame, and are never saved or sent.
What reaches us is the result, not you: whether you passed, when, how confident the check was, which prompts you completed and how long each took, and technical details about your device such as its model, operating system, app version, language and time zone. There is no image in it and nothing that describes how you look.
We do not compare your face against any database, against any other user, or against any photograph.
The check does not estimate your age. It does not estimate your gender, your mood, your ethnicity, or anything else about you. Section 3 explains how we check your age.
There is no retention period for anything taken from the camera, because nothing from the camera is retained. We keep the result described above, the pass, the time, the device details, for 12 months, so that we can show a check was carried out if we are ever asked, and so that we can investigate abuse.
This check is not a login and it is not a password. It does not identify you, and it cannot be used to sign you in. It only confirms that a live human being, rather than a script or a photograph, is using the app.
Where the check is offered: to the extent it involves collecting or capturing a scan of face geometry, or any other biometric identifier or biometric information as those terms are used in the Texas Capture or Use of Biometric Identifier Act and similar laws, you consent to and authorise CLZTR SpA to collect, capture and process it for the sole purpose of confirming that a live person is present. It is not stored, sold, leased, traded or disclosed to anyone. We ask for that consent separately, on its own screen, before your camera is ever activated.
Our Biometric Data Retention and Destruction Policy is published and applies to anything that may be deemed a biometric identifier or biometric information, under this section and under section 5.2.
5.2 Identity verification (accounts)
If you create an account, you verify your identity once. You photograph an identity document, such as a passport or a national ID card, and you take a photograph of yourself.
This is a different process from the face check in section 5.1, and it works differently. Here, the two photographs are sent to us and we keep them. This section tells you exactly what we do with them.
We check that the document is genuine, valid and unexpired, and we read your name and date of birth from it.
A trained person at CLZTR looks at your photograph and at the photograph on your document and decides whether they are the same person. That decision is made by a human being looking at two pictures.
We do not use face recognition to do it. We do not measure your face, we do not create a faceprint, face template, face embedding or face hash from either image, and neither image is run through face-recognition software. Nothing that could be used to recognise you elsewhere is created.
If we ever change that and introduce automated face matching, we will tell you before it applies to you, we will ask for your consent separately, and you will be able to refuse and still keep your account.
Your photograph and your document images are stored on our servers, encrypted, and are accessible only to the small number of staff who carry out this review.
We delete both images within 7 days of the decision. We keep them longer only if there is a specific reason to, you have appealed the decision, we are investigating a fraud or safety report that concerns your account, or we are required to keep them for a legal claim or an official request. In those cases we keep them only until that matter is closed, and in no event beyond 12 months.
We keep the record of the decision, that you were verified, when, by which route, and the outcome, for 5 years. That record contains no images.
We keep your name, your date of birth, and a one-way code derived from the document number so that the same document cannot be used to create more than one account.
We do not sell, rent, trade or disclose either image, and we do not use them to train any model.
You can see the deletion date for your own images in Settings › Verification. If you believe they should already have been deleted, email legal@clztr.com.
Once you are verified, you are verified. We will not ask you to do the face check again.
We may ask you to verify again in a small number of situations where the account may no longer be in your hands: you sign in from a device we have not seen before, you sign in from a new country that does not match your history, you change your email address or password, your account has been inactive for a year or more, or we are handling a safety report about your account. These checks exist to protect your account, not to inconvenience you, and most people will never see one.
5.3 If the check does not work for you
If you cannot complete the face check for any reason, including a disability, a device limitation or repeated failures, you can verify with an identity document instead. If neither works for you, contact service@clztr.com and a person will review your case.
5.4 If you do not complete the check
If you use CLZTR anonymously and do not complete your monthly check, you can complete it whenever you next open the app, or create an account instead.
If you sign in with an email address but have not yet verified your identity, you can use CLZTR for up to three sessions while you complete verification. After that, you will need to verify your identity, or complete the face check if that option is available where you are, before you can open the map again. Your account, your content and your subscription are not affected while you are waiting.
6. Your account
You are responsible for your account and for everything that happens through it. Keep your email address secure. Tell us at service@clztr.com if you think someone else has access.
Do not sell, rent, share or transfer your account. Do not create an account for someone else, and do not create more than one account for yourself.
We may refuse to create an account, or close one, if we reasonably believe these Terms have been broken.
If you use CLZTR without an account, there is nothing to keep secure and nothing to share, because we hold no identity for you. The same rules still apply: do not use the app to evade a ban, and do not run more than one device in order to get around a limit.
7. What you may not do
CLZTR is a place where people meet in the real world. That means these rules matter more here than they would elsewhere. Our Community Guidelines form part of these Terms and explain each of these in detail.
Content that is never allowed on CLZTR, on any plan, whether you pay or not:
Sexual content. Nudity, sexual acts, sexual solicitation or sexually explicit material.
Violent content. Threats, incitement to violence, glorification of violence, graphic violence, terrorist or extremist content, or content promoting weapons.
Political content. Party political campaigning, electoral propaganda, political mobilisation content, and extremist political symbols.
Hate. Attacks on people because of race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity or sexual orientation.
Content involving minors. Any sexual content involving a minor. We report this to the authorities and to the relevant reporting bodies in every case, without exception.
Illegal goods and services. Drugs, weapons, counterfeit goods, stolen goods, or the sale of sexual services.
Behaviour that is never allowed:
Harassing, stalking, threatening, intimidating or impersonating anyone.
Using CLZTR to find, follow or approach a specific person who does not want to be found.
Publishing anyone's private information, including their home address or their location, without their consent.
Creating fake clusters or events, or claiming to be somewhere you are not.
Circumventing or attempting to circumvent verification, bans, or any limit on your plan.
Scraping, crawling, reverse engineering, or accessing CLZTR by automated means.
Spamming, mass unsolicited messaging, or manipulating referrals or rewards.
Anything unlawful where you are.
We do not allow political content regardless of viewpoint, and we do not allow sexual or violent content regardless of which plan you are on. These rules apply equally to everyone.
8. Your content
You keep ownership of everything you post on CLZTR.
By posting, you give CLZTR a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and distribute your content, solely to operate, promote and improve the Service. This licence ends when you delete the content or close your account, except where the content has been shared with others who have not deleted it, or where we must keep a copy to comply with a legal obligation.
You promise that you have the rights to what you post, and that it does not break section 7 or anyone else's rights.
We are not obliged to store your content and we do not guarantee backups. Keep your own copies of anything that matters to you.
If you believe content on CLZTR infringes your copyright, our notice and takedown process is at clztr.com/dmca.
Our content and our brand. Everything that is not yours is ours or our licensors'. The CLZTR name, the CLZTR logo, our visual identity, and the text, design, software and databases behind clztr.com, clztr.app and the app are the property of CLZTR SpA, and all rights in them are reserved. CLZTR is a registered trade mark of CLZTR SpA, registered with the Instituto Nacional de Propiedad Industrial (INAPI) of Chile; outside Chile the name and logo are protected as unregistered marks and by the law of unfair competition and passing off.
You may not use them without our written permission. That includes using our name or logo in your own app, product, service or advertising; registering a company name, domain, social handle or app name that is identical or confusingly similar to ours; presenting yourself as CLZTR or as affiliated with us when you are not; and copying our design, text, layout, database or software. We enforce this, through takedown and dispute proceedings with app stores, domain registrars and platforms, and through legal action seeking injunctive relief, damages, an account of profits and our costs. If you want to use our name or logo for press, a partnership or an integration, write to legal@clztr.com and ask.
9. Location and the map
Where you are is yours. How CLZTR works reflects that.
Your own position on the map is calculated on your device. Your continuous location is not sent to us and we do not build a history of where you go.
We only learn where you are when you deliberately tell us: when you confirm you are at a cluster, when you check in, or when you take another explicit action that says so.
We do not track you in the background. CLZTR does not use background location.
Sharing your live position with friends is an optional feature on our top plan. It is off by default, it requires the consent of both people each time, and either person can turn it off at any moment.

10. Plans, payments and Cluster Points
This section covers the plans we offer, how payment and refunds work, and how Cluster Points are earned and spent.
10.1 Plans
CLZTR is free to use. We also offer paid plans that unlock additional features. What each plan includes is shown in the app and may change over time, with notice where the change is material.
10.2 Payment
Subscriptions are sold through the Apple App Store and the Google Play Store, and those stores are the seller. They handle your payment, your renewal and your receipts under their own terms.
Subscriptions renew automatically until you cancel. Cancel through your App Store or Google Play account settings, not through us. We cannot cancel or refund a store subscription for you.
Prices are shown in your local currency before you pay and include taxes where required.
10.3 Refunds
Refunds for subscriptions are handled by Apple or Google under their policies. We will help where we can, but the decision is theirs.
This does not affect any refund or cancellation right you have under the consumer law of your country, including the withdrawal rights available to consumers in the European Union, the United Kingdom, Brazil, Chile and elsewhere.
10.4 Cluster Points
Cluster Points are a way of recognising participation on CLZTR. Points may be redeemed for temporary access to features inside CLZTR.
Cluster Points are not money. They have no cash value. They cannot be withdrawn, transferred, sold or exchanged for cash or for anything outside CLZTR. They are not a security, an investment, a token or a financial instrument, and they do not entitle you to any share of CLZTR's revenue, profit or ownership. CLZTR does not operate any revenue-sharing programme and does not promise one.
We may change how points are earned, what they unlock, and how long they last. Points expire as described in the app. Points earned in breach of these Terms may be removed.
11. Moderation, enforcement and appeals
We review content and behaviour on CLZTR, using a combination of automated systems and human reviewers.
If we remove your content or restrict your account, we will tell you what we removed, which rule it broke, the facts we relied on, whether the decision was made automatically, and how to appeal.
Depending on what happened, we may: remove content, issue a warning, limit some features for a period, hide a cluster or freeze an event, suspend an account, or ban an account permanently. We aim to respond proportionately, and repeated or serious breaches lead to permanent removal.
You can appeal any decision. Appeals are reviewed by someone other than the person who made the original decision, and we aim to answer within 5 business days. The appeal link is in every notice we send you.
Reporting. You can report any profile, cluster, event, message or piece of media from inside the app. Reports about immediate danger, threats or minors are treated as our highest priority and are reviewed within 24 hours.
Reporting to authorities. Where the law requires it, or where we believe in good faith that there is a risk of serious harm to a person, we will report to law enforcement or to the appropriate authority, and we will cooperate with lawful requests. We do this whether or not you are told in advance, where telling you in advance is unlawful or would increase the risk.
Requests from authorities must be sent to legal@clztr.com. We check that they are valid, we disclose only what the legal basis covers, and we log every request. Where the law allows, we tell the person affected.
12. Safety: please read this
CLZTR helps you find places and people in the real world. That carries real risk, and we want to be honest about what we do and do not do.
We confirm that a real person is using CLZTR. We do not vet who that person is. Passing a check does not mean someone is safe, honest, or who they say they are.
We do not run criminal background checks on anyone.
We are not an emergency service. If you are in danger, call your local emergency number immediately. Do not use CLZTR to ask for emergency help.
You decide who you meet and where. Meet in public, tell someone where you are going, and leave whenever you want to.
Events and venues on CLZTR are run by the people who create them, not by us. We are not responsible for what happens at them.

13. Availability and changes to CLZTR
We work to keep CLZTR available, but we do not promise it will be uninterrupted or error-free. We may suspend it for maintenance, for security, or to comply with the law.
We may change CLZTR. We add, change and remove features. Where a change materially reduces what you get on a paid plan, we will tell you at least 30 days beforehand and you may cancel.
We may change these Terms. If we do, we will post the new version with a new effective date and, where the change is material, tell you at least 30 days in advance, in the app or by email. If you keep using CLZTR after the change takes effect, you accept the new Terms. If you do not accept them, stop using CLZTR and close your account.
We may stop offering CLZTR in a country where the law changes, where we cannot operate lawfully, or where we believe there is a serious risk to our users. Where we can, we will give notice.
14. Ending this agreement
You can leave at any time. Delete your account from Settings in the app. Deletion is always available, whatever state your account is in, and you never have to contact us to do it. Some data is kept for a limited period where the law requires it, as described in our Privacy Policy.
If you use CLZTR without an account, Settings has an Erase my data option that does the same thing. You do not need to create an account, sign in, or give us an email address in order to erase what is held for your device.
We can end your access if you break these Terms or the Community Guidelines, if we are required to by law, or if we reasonably believe your use puts other people at risk. Where it is appropriate and lawful, we will tell you why and you may appeal.
If your account ends, sections 8 (the licence for content others still hold), 10.4, 15, 16 and 17 continue to apply.
15. Limits on our liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
Subject to that:
CLZTR is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties that are not expressly stated in these Terms.
We are not liable for: loss of profit, revenue, business, goodwill or data; indirect or consequential loss; or loss arising from the acts of other users, from events you attend, from anyone you meet through CLZTR, or from content you find on CLZTR.
Where we are liable, our total liability to you for all claims in any 12-month period is limited to the greater of the amount you paid us in that period and USD 100.
These limits do not affect your statutory rights as a consumer. If you are a consumer in the European Union, the United Kingdom, Australia, Brazil, Chile, Mexico or another country whose law gives you rights that cannot be excluded, those rights apply and take precedence over anything in this section. In Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
16. Your responsibility to us
If someone brings a claim against us because of something you did on CLZTR, because of content you posted, or because you broke these Terms or the law, you agree to cover our reasonable losses, damages and legal costs arising from it. This does not apply where the claim results from our own breach or negligence, and it does not apply to consumers to the extent the law of your country does not allow it.
17. Governing law and disputes
Which law applies to these Terms, and where a dispute is heard, depends on where you live. The subsections below set out each case.
17.1 If you are a consumer
The law of your country of residence applies, and you can bring proceedings in the courts of your country of residence. Nothing in these Terms removes the protection of the mandatory consumer law where you live.
If you are in the European Union, you may also use the consumer dispute resolution channels available in your country. Details of the alternative dispute resolution entities that cover us are in our Legal Notice.
If you are in Chile, Ley 19.496 applies and you may bring a claim before SERNAC or the competent local court.
If you are in Brazil, the Código de Defesa do Consumidor applies and you may bring a claim in the court of your domicile.
17.2 If you are in the United States and are not covered by 17.1
Please read this. It affects how disputes are resolved.
You and CLZTR agree that any dispute arising out of or relating to these Terms or CLZTR will be resolved by binding individual arbitration, not in court and not as a class action, except that either of us may bring an individual claim in small claims court, and either of us may seek an injunction in court to protect intellectual property.
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, then in effect, in English. It may be conducted on documents alone, by telephone or video, or in person in your county of residence, at your choice. CLZTR will pay the AAA filing and administration fees for claims under USD 10,000. The arbitrator may award the same individual relief a court could.
You waive the right to participate in a class action or a class arbitration. If this waiver is held unenforceable, the whole of section 17.2 does not apply to that dispute.
You may opt out of arbitration. Email legal@clztr.com within 30 days of first accepting these Terms with your name and the words "arbitration opt-out". Opting out does not affect anything else in these Terms.
17.3 Everyone else
These Terms are governed by the laws of Chile, and the courts of Valparaíso, Chile have jurisdiction.
This clause is subject to 17.1 and does not apply to consumers. If you are a consumer, the choice of Chilean law above does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country. Where those rules conflict with anything in these Terms, those rules prevail.
18. Other things
The whole agreement. These Terms, the Community Guidelines, the Privacy Policy and the Biometric Data Retention and Destruction Policy are the whole agreement between you and CLZTR about the Service.
If part of this is unenforceable, the rest still applies.
If we do not enforce something immediately, we have not given up the right to enforce it later.
You cannot transfer your rights under these Terms. We may transfer ours to a company that takes over our business, on notice to you.
No third-party rights. These Terms do not give rights to anyone who is not you or us.
Language. These Terms are published in English, Spanish and Portuguese. Where there is a conflict, and unless the law where you live requires otherwise, the English version prevails.

Annex A, European Union and United Kingdom
How we moderate. We use automated systems and human reviewers to detect and act on content that breaks our rules or the law. Automated systems flag content; a person makes decisions that restrict an account. When we act, we tell you what we did, why, the facts we relied on, whether the decision was automated, and how to appeal.
Notice and action. Anyone can notify us of illegal content through the report tools in the app or at legal@clztr.com. We confirm receipt, decide without undue delay, and tell both the person who notified us and the person affected.
Points of contact. Authorities: legal@clztr.com, and our EU representative. Users: service@clztr.com, and the report and appeal tools inside the app. We accept communications in English, Spanish and Portuguese.
Our EU representative under Article 27 GDPR and Article 13 of the Digital Services Act is Klaus Göldberg, Bart de Ligtstraat 17, 1097 JG Amsterdam, Netherlands, europe@clztr.com.
United Kingdom. We are in the process of designating a representative under Article 27 of the UK GDPR. Until one is named here and in our Legal Notice, write to legal@clztr.com for anything that would otherwise go to them, and to exercise your data protection rights.
Average monthly active recipients in the European Union are published in our Legal Notice and updated every six months.
Automated decisions and AI. Where we use AI systems, we tell you. Our liveness check estimates nothing about you other than whether a live person is present. Where insights or summaries are generated by AI, they are labelled as such.
Annex B, United States
State privacy rights. Depending on where you live, you may have the right to know what personal information we collect, to delete it, to correct it, to opt out of its sale or sharing, and to limit the use of sensitive personal information. We do not sell or share your personal information. To exercise your rights, contact legal@clztr.com. We will not discriminate against you for exercising them.
Do Not Sell or Share. A link is provided in the footer of clztr.com. We honour Global Privacy Control signals.
Biometric laws. The face check described in section 5.1 does not run in Illinois. Where it is offered, our Biometric Data Retention and Destruction Policy at clztr.com/biometrics applies in Texas, Washington, Colorado and elsewhere. Section 5.1 above describes exactly what happens during the check.
Copyright. Our designated agent under the Digital Millennium Copyright Act is listed at clztr.com/dmca.
Annex C, Chile

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in section 15 limits those guarantees.

We acknowledge every complaint within 24 hours and resolve it within 7 days. Content that is unlawful is acted on within 36 hours of a valid notice. Orders received through the Sahyog portal or from a court are acted on within 3 hours. Registration data is retained for 180 days after an account is closed, as those Rules require.
These Terms, our Privacy Policy and our Community Guidelines are the rules and regulations, privacy policy and user agreement referred to in Rule 3(1)(a).
